    I have to wonder if this new Nonprofit Rivitalization Act which forces and independent audit on the WT corporation will find them operating out side the guideline of a legitimate charity over this robbery of funds from the rank and file.

    It must seem awful on the audited books no matter how they much they cook their books. I'm sure this whole mess can be untangled with a good independent audit, designed to bring back trust into charities by forced transparency.

    Conflict of Interests Policies

    The Revitalization Act requires all nonprofit corporations and charitable trusts to adopt a written conflict
    of interests policy. The law requires that the policy contain these provisions:

     a definition of the circumstances that constitute a conflict of interest;
     procedures for disclosing a conflict to the audit committee or the board;
     a requirement that a person with a conflict not be present at or participate in board or
    committee deliberations or vote on the matter creating conflict;
     a prohibition against any attempt by a person with a conflict to improperly influence
    the deliberation or vote;
     a requirement that the existence and resolution of a conflict be documented in the
    organization’s records, including in the minutes of any meeting where the conflict
    was discussed; and
     procedures for disclosing, addressing, and documenting related-party transactions.

    Also, the Revitalization Act adds a requirement to the law that before a director is elected to a board of
    a nonprofit corporation, and annually thereafter, the director must submit a signed statement to the
    board secretary identifying all of the entities of which the director is an officer, director, trustee,
    member, owner or employee, and any transaction in which the corporation and director might have a
    conflict of interest.

    It is bigger than this.

    The way law is being applied in the States, Europe and elsewhere in the developed world, big organizations which have preyed upon little people may find they have cases to answer.

    Imagine the WTBTs gross potential liability for damage to people's lives. People to include non-members (say, relatives or other loved ones).

    $10 billion or more? Roughly the value of its real estate portfolio?

    The WTBTS legal teams have advised to get out of property, as real estate is highly illiquid and even if its ownership can be sheltered via the use of a hierarchy of holding entities, the underlying physical asset remains accessible and a Court may just set aside all the legal fictions which stand in the way of realising that asset, and look through them as if they weren't there - both in Europe or the States.

    So, we need to explore this avenue thoroughly, before she runs off and hides the loot where we can't get at it.

    With very great difficulty and after much effort and time, LostGeneration. That goes without saying, doesn't it?

    The legal principles in both English-, and other European-, based legal systems, that recoverable damages should be measurable / liquidated, that they should not be too remote from the (alleged) cause and that the claimed victims did not themselves reasonably consent (if so, they may be estopped from proceeding - the doctrine of promissory estoppel) all represent considerable hurdles.

    I am being deliberately vague and brief here.

    The total size of payouts (not awards, as these are appealed) by the tobacco industry to date shows us the scale of the hurdles.

    Indeed, there are parallels between the two scams.

    "No one forced you to smoke," for example.

    But then, what about "born into the cult" victims?

    In reply - there's evidence that mothers who smoked during or just before pregnancy may pass on the addiction to the foetus.

    But still, no payouts.

    So the parallel continues, in a manner.

    Our difficulties are, thus, mirrored there.

    But given the potential size of the payout (both in $$$ terms and, more importantly, those of shutting down the cult), isn't the effort worth it?

    Another thing is for certain. Don't try, won't get.
