Breaking News: Berry girls lose high court appeal
by loveis inwith those two short, sweet, words of the nh supreme court, the berry girls 4-year fight to hold the wts responsible has come to an abrupt and bitter end.. a preliminary scan of the opinion indicates a virtual slam-dunk victory for the wts, although there was one dissenting justice out of the four on one issue only, the only female justice of the four.

1997 -- holly brewer (incorrectly called "holly berry" in nh supreme court filings) returns to new hampshire after running away from home, and for the first time discloses the brutal sexual assualts suffered during her childhood by then-stepfather paul berry (by this time divorced from her mother sarah, now sarah poisson, for a number of years).

BREAKING NEWS: Decision coming down tomorrow in Berry girls' appeal!
by loveis inthe new hampshire supreme court's official site lists the decision for this case (holly berry & a. v. watchtower bible and tract society of new york, inc. & a.
) among those "to be released july 15.".
this decision will be huge for whomever it goes for (the silentlambs or the wts) since it will be from a state supreme court, and thus precedent-setting for the other ongoing cases throughout the country.

BERRY GIRLS' NEW HAMPSHIRE SUPREME COURT APPEAL IS FINALLY SET!!!
by loveis inthe sad saga of the berry girls (holly brewer and heather berry) and their mother, sarah poisson, is well known to most longtime posters here, having been featured prominently on the jw abuse shows on television, notably at length in the ones in the uk (bbc panorama, "suffer the little children", july 2002) and canada (fifth estate, "spiritual shepherds", january 2003).
the civil suit they brought against the wts in the new hampshire state courts was referred to.
that suit was going well in pretrial motions and depositions, etc., until it was dealt a serious and potentially fatal setback by a decision made by the judge in june 2003, which was blaste--er, discussed--in these threads: .

posted below is a past new hampshire supreme court case that is very favorable to the wts position in the berry girls' case, and has surely been cited by them big time in their briefs (it was mentioned briefly by wts lawyer donald gardner in the audio, which has been posted on these boards several times, of the oral argument session before the nh supreme court.
laws 1971, 531:2. in 1973, the penalty section was amended to provide that a violation would constitute a misdemeanor.

stung by 2 high court defeats just 2 days apart, marci fights back, showing where she believes the justices erred and what the state legislature now needs to do in each case.
the question for the new hampshire supreme court was whether the elders had a duty of care toward the girl.
