  In ancient Israel, trials were conducted in public at the city gate. There was no provision for confidentiality. The verse about "confidential talk" was about private, personal or business matters, which wouldn't go to judicial court anyway.

  In the instance with Paul and the "disfellowshipping" in Corinth, everybody knew exactly what was going on, there were no secret meetings in a windowless room.

  The whole "make no recordings" thing was to try and cover the a$ses of the ignorant, self-righteous, bullying, and arrogant elders.
