WASHINGTON (AP) -- Hours after President Barack Obama signed historic health care legislation, a potential problem emerged. Administration officials are now scrambling to fix a gap in highly touted benefits for children.
Obama made better coverage for children a centerpiece of his health care remake, but it turns out the letter of the law provided a less-than-complete guarantee that kids with health problems would not be shut out of coverage.
Under the new law, insurance companies still would be able to refuse new coverage to children because of a pre-existing medical problem, said Karen Lightfoot, spokeswoman for the House Energy and Commerce Committee, one of the main congressional panels that wrote the bill Obama signed into law Tuesday.
However, if a child is accepted for coverage, or is already covered, the insurer cannot exclude payment for treating a particular illness, as sometimes happens now. For example, if a child has asthma, the insurance company cannot write a policy that excludes that condition from coverage. The new safeguard will be in place later this year.
Full protection for children would not come until 2014, said Kate Cyrul, a spokeswoman for the Senate Health, Education, Labor and Pensions Committee, another panel that authored the legislation. That's the same year when insurance companies could no longer deny coverage to any person on account of health problems.
Obama's public statements have conveyed the impression that the new protections for kids were more sweeping and straightforward.
"This is a patient's bill of rights on steroids," the president said Friday at George Mason University in Virginia. "Starting this year, thousands of uninsured Americans with pre-existing conditions will be able to purchase health insurance, some for the very first time. Starting this year, insurance companies will be banned forever from denying coverage to children with pre-existing conditions."
And Saturday, addressing House Democrats as they approached a make-or-break vote on the bill, Obama said, "This year ... parents who are worried about getting coverage for their children with pre-existing conditions now are assured that insurance companies have to give them coverage -- this year."
Late Tuesday, the administration said Health and Human Services Secretary Kathleen Sebelius would try to resolve the situation by issuing new regulations. The Obama administration interprets the law to mean that kids can't be denied coverage, as the president has said repeatedly.
"To ensure that there is no ambiguity on this point, the secretary of HHS is preparing to issue regulations next month making it clear that the term 'pre-existing exclusion' applies to both a child's access to a plan and his or her benefits once he or she is in the plan for all plans newly sold in this country six months from today," HHS spokesman Nick Papas said.
The coverage problem could mainly affect parents who purchase their own coverage for the family, as many self-employed people have to do. Families covered through employer plans typically do not have to worry about being denied coverage because of pre-existing conditions.
Parents whose kids are turned down by an insurer would still have a fallback under the law, even without Sebelius' fix. They could seek coverage through state high-risk insurance pools slated for a major infusion of federal funds.
The high-risk pools are intended to serve as a backstop until 2014, when insurers no longer would be able to deny coverage to those in frail health. That same year, new insurance markets would open for business, and the government would begin to provide tax credits to help millions of Americans pay premiums.
An insurance industry group says the language in the law that pertains to consumer protections for kids is difficult to parse.
"We're taking a closer look at it to see what exactly the requirement will be," said Robert Zirkelbach, spokesman for America's Health Insurance Plans, the main industry lobby.

The health care reform bill signed into law by President Barack Obama Tuesday requires members of Congress and their office staffs to buy insurance through the state-run exchanges it creates – but it may exempt staffers who work for congressional committees or for party leaders in the House and Senate.
Staffers and members on both sides of the aisle call it an “inequity” and an “outrage” – a loophole that exempts the staffers most involved in writing and passing the bill from one of its key requirements.
The bill requires “congressional staff” to buy insurance from the exchanges – with a stipend from the Office of Personnel Management But page 158 of the bill defines “congressional staff” narrowly, as “employees employed by the official office of a member of Congress, whether in the district office or in Washington.”
The Congressional Research Service believes a court could rule that the legislation "would exclude professional committee staff, joint committee staff, some shared staff, as well as potentially those staff employed by leadership offices.”
If that’s so, staffers who work for Nancy Pelosi in her capacity as representative from California would go into the exchange program, while staffers who work for her in her capacity as speaker would stay on the government’s plan. Other Capitol employees, like those who work for the clerk of the House or the House historian, would be similarly exempted.
Republican Sens. Tom Coburn of Oklahoma and Chuck Grassley of Iowa, who both say they tried to correct the issue last year, are firing at Senate leaders, saying that Democrats purposely exempted upper-level staffers out of the bill.
Last September, the Senate Finance Committee adopted a Grassley amendment into its version of the bill, mandating that members of Congress and their staff get their health insurance through the exchanges. It was agreed to by unanimous consent.
Coburn had earlier filed a similar amendment in the Health, Education, Labor and Pensions Committee, which passed with some Democratic support.
However, when the combined Senate bill came to the floor, the definition of staff had been narrowed. Both senators filed a second amendment in December restating their original intent, but they say Democrats blocked it.
“The American people will be appalled to learn the health care bill exempts leadership and committee staff. This special deal for unelected staff underscores everything the public detests about the arrogance of power in Washington,” Coburn said. “I tried to fix this inequity along with senators Grassley, Burr and Vitter, but Majority Leader [Harry] Reid obstructed our effort.”
Reid spokesman Jim Manley acknowledged that the bill exempts committee staff but argued that leadership staff is not excluded. As for why committee staff is excluded, Manley said that when leaders merged the health care bills from the Finance Committee and the Health, Education, Labor and Pensions (HELP) Committee, they took Coburn’s language from the HELP Committee rather than Grassley’s Finance Committee proposal because they feared Grassley’s language was so broad that it would have required “people like legislative counsel, Architect of the Capitol, etc.” to participate in the exchanges, too.

Another thing about this healthcare, it's not gonna be free. The law requires that you have to purchase health insurance through a "private sector". Nothing states in the bill about capping how much you pay per month. Even if you do get health insurance through your employer, it's gonna cost you a portion of your paycheck, how much that will be, none will know until we see the first paycheck showing how much it was taken out.
As of right now, there's talks of loopholes. Laying off full time workers and going for temps which won't require providing them healthcare and also contractors. Outsourcing is another option, no law states you have to provide health insurance to employees overseas.
So when the law takes effect, start expecting massive layoffs.
So when people are laid off, the law still requires you to obtain health insurance, how will you pay for it if you have no money coming in to pay for it? You're an instant criminal right then and there.

Maybe, but it will take effect long before the Healthcare law begins. So I'd watch all of your utility bills, phone bill, watch the gas prices go up for your SUV, food and everything else. Not all is gonna go up right away, but they will go up nonetheless over time.
