    It wasn't that many years ago that jury service was a "no-no." Anybody know when it changed to a conscience issue? I think it was the mid-nineties.

    At least in our area, the issue rarely came up because at one time they only called registered voters. However, for about the last ten years they call anyone who has a driver's license.

    I served just once. Out of about 80 people in the room, I was picked. Somehow I ended up being the spokesperson. It was a pretty clear cut case though and it only took a few hours to decide that guy was guilty of physically abusing his girlfriend.

    I reported for jury duty when I was a JW. Never used any religious reason. It's been a conscience matter for JWs for some time though some missed that change.

    I was disqualified from one because I knew the judge personally.

    On the other, the settled out of court just before we were to go in.

    Believe me, I have seen too many non-JWs who will try anything to get out of serving.

    • What should be the Christian’s position regarding work in defense plants, serving on juries, selling Christmas cards or trees, etc?—Composite question based on many inquiries.The Watchtower Society is organized for the purpose of preaching the good news of the Kingdom in all the inhabited earth for a witness to all nations, and it encourages and aids all to have a part in that work, freely advising as to the most effective procedures. As to other forms of activity or work the Society has no specific recommendation to make. To draw up rules for all the possible situations relative to secular work would embark us upon the compilation of a voluminous, Talmudlike set of regulations, seeking to make all the fine distinctions as to when and when not certain work becomes objectionable. The Lord has not laid that responsibility upon the Society; it is each individual’s responsibility to decide his own case. To illustrate the problem involved, consider the matter of selling Christmas cards or trees. If that is wrong, then what about the butcher that sells a turkey for a Christmas dinner, or the saleslady that sells a sweater to be used as a Christmas present? Where is the line to be drawn? Or, when does work become defense work? You do not have to be working on a tank assembly line to be making items used in warfare. As for jury duty, would you be acceptable for this service, say, in a divorce case where one might be granted on grounds other than adultery? Your Christian conscience might eliminate you, rendering you unacceptable to one or both sides of the case.

    The Society’s silence on these matters is not to be viewed as giving consent, nor is it to be viewed as a condemnation we do not wish to openly express. It means that we think it is the individual’s responsibility to choose, not ours. It is his conscience that must be at ease for his course, not ours. He knows all of the circumstances, not we. Jehovah’s witnesses have read their Bibles and studied the Watchtower publications that have endeavored to make plain the righteous principles and requirements of Jehovah for the guidance of Christians. Each one should now be able to determine for himself what he can conscientiously do in the way of secular work. We must remember that, while no part of the world or its schemes and hopes for continuance, we are in it and cannot separate completely from its activities. So let each one accept his own responsibility and answer to his own conscience, not criticizing others or being criticized by them, when individual consciences allow different decisions on the same matter. We should not be "judged by another person’s conscience". "Who are you to judge the house servant of another? To his own master he stands or falls."—Rom. 14:4; 1 Cor. 10:29, NW.

    The Bible’s View

    Should a Christian Serve on a Jury?MANY persons look to the court or judicial system for justice. In lands where what is called "civil law" prevails, legal cases (both criminal and civil) are usually heard and decided on by a single professional judge, or by a panel of justices. But a distinctive feature of "common law" countries is the use of juries composed of average citizens. A jury of 12 or so persons hears the evidence and determines guilt or innocence. Then, depending on the type of case, the judge may sentence the guilty parties.

    Naturally, if you live where the possibility exists of being called for jury duty, you might well ask, Should a Christian serve on a jury? But even if you live where such juries are not used, you can profitably consider the question, for some of the relevant Bible principles can apply to you if you are asked to "judge" in a dispute on your job or to "mediate" some dispute in your neighborhood.

    What Christian Obligations?

    Serving as a juror is often described as a valid civic duty. It has been reasoned that all citizens benefit from courts and so should be willing to be jurors, even as all benefit from other governmental services and so should pay taxes for these.

    This view is of interest to Christians because of what the apostle Paul wrote about governmental "superior authorities." He counseled: "You must all obey the governing authorities. . . . The state is there to serve God for your benefit. . . . Pay every government official what he has a right to ask—whether it be direct tax or indirect, fear or honour."—Rom. 13:1-7, The Jerusalem Bible.

    Understandably, Paul did not here mention serving on a jury, for under Roman rule there were no citizens’ juries as now exist under Anglo-American law. Still, some persons have reasoned that the local or national government is "taxing" one’s time in requiring any qualified citizen to serve briefly as a juror. And it is noteworthy that in most places being a juror does not involve sharing in political matters, which a Christian would not do because of his neutral position. (John 15:19; Isa. 2:1-4; Acts 5:29) Hence, some Christians have concluded that they ought to accept jury duty.

    Other Christians, though, have decided otherwise. For example, in 1966 the Supreme Court of Appeals of West Virginia upheld a Christian who refused jury duty. The court opinion reported that he

    "stated that it violated his personal freedom of conscience to serve as a juror and that he felt he had authority under his religious beliefs to serve within his congregation with power to judge or decide but not to so serve outside his congregation and cited quotations from the scriptures to support his belief." (West Virginia vs Everly)

    What scriptures do you think he had in mind? Some have referred to Jesus’ words in Matthew 7:1, 2: "Stop judging that you may not be judged; for with what judgment you are judging, you will be judged." However, the context shows that Jesus was speaking about a personal or private type of judging, such as criticizing the personal habits and preferences of others. (Rom. 14:1-4, 10) However, a minister might well refer to Luke 12:13, 14 and 1 Corinthians 5:12–6:8.

    The first passage tells of a Jewish man who asked Jesus to judge in a legal dispute over inheritance. Christ refused, saying "Who appointed me judge or apportioner over you persons?" The congregation of Israel had God’s laws on inheritance and designated older men to resolve disputes of that sort. Moreover, Jesus was not sent to earth to arbitrate in such a matter, but was commissioned to use his time preaching the Kingdom good news.

    The second passage pertains to a case of wrongdoing in the Corinthian congregation. Paul directed the brothers to expel the wrongdoer. Then the apostle added: "For what do I have to do with judging those outside? Do you not judge those inside [the congregation], while God judges those outside?" He went on to state that Christians should strive to avoid even taking their grievances or disputes to worldly courts for handling.

    This Biblical counsel certainly should alert Christians to be slow about getting involved in others’ personal differences, especially those outside the congregation. And you can appreciate why the Christian in West Virginia might conclude that his efforts to ‘judge or decide’ matters should be confined to the congregation, rather than be a juror in a secular court of law.

    Some Christians have also reflected on the types of cases that jurors might face. For instance, in some places capital punishment is a possible or mandatory sentence for a person found guilty of certain crimes. While the Bible upholds a government’s right to execute a murderer, the individual asked to serve as a juror might question whether he could decide solely on the information presented at a trial. (Gen. 9:5, 6) Or a case could involve abortion, divorce, child custody, or another issue on which the Christian follows God’s thinking even when the law of the land differs. So could he agree, such as when being examined for jury selection, to make his decisions strictly according to civil law?

    A different problem is illustrated with a nurse in Texas who was a juror at the trial of a young man, son of a prominent family, who was accused of beating to death another youth. During the trial she realized that on her job at the hospital she had seen X rays of the victim, which were rejected as evidence at the trial. Unlike the other jurors, she could not accept the claim that the injuries came from an accidental fall. The others, though, pressured her to side with them to avoid a "hung jury" and subsequent retrial. The nurse, having studied the Bible with Jehovah’s Witnesses, resisted for days. But finally she agreed to vote for acquittal. Though years have now passed, her conscience still troubles her; she feels that she was part of a miscarriage of justice. Even in other ways, might this sort of problem arise for a Christian juror? It is something to consider.

    What to do? Some Christians have refused jury duty, perhaps mentioning to the authorities how impractical it would be to compel a person to sit through a trial and then have a "hung jury" because he feels he would not want to pass judgment on anyone’s guilt. (1 Pet. 3:16) Other Christians, though, have accepted jury duty but have asked to be excused from those cases where they felt their Bible-based thinking would be at variance with secular laws. Still others have accepted any jury assignment, feeling that it is Caesar’s right to oblige persons to serve in the civil capacity of hearing evidence and honestly deciding on questions of fact or guilt. (Matt. 22:21) Since the Bible does not pointedly discuss jury duty, each one must personally decide what to do after considering all that is involved in jury service, as well as Bible principles and his own conscience.

Many Christians have in good conscience concluded that Bible principles do not rule out appearing, even as Shadrach, Meshach, and Abednego complied with the directive of the Babylonian government to appear on the plain of Dura and as Joseph and Mary went to Bethlehem at the direction of the Roman authorities. (Daniel 3:1-12; Luke 2:1-4) There are, though, factors that sincere Christians can consider.

    The use of juries is not universal. In some lands, civil and criminal cases are decided by a professional judge or a panel of judges. Elsewhere, what is known as common law prevails, and juries are part of the judicial process. Still, most people have only a vague idea of how juries are selected and what they do. So getting an overview will be helpful whether you face jury duty or not.

    God’s people recognize Jehovah as the Supreme Judge. (Isaiah 33:22) In ancient Israel, experienced men who were upright and impartial served as judges to resolve disputes and decide questions of law. (Exodus 18:13-22; Leviticus 19:15; Deuteronomy 21:18-21) By the time Jesus was on earth, the judicial function was handled by the Sanhedrin, the Jewish high court. (Mark 15:1; Acts 5:27-34) There was no provision for the average Jew to be on a civil jury.

    Other lands used juries made up of citizens. Socrates was tried by 501 jurors. Trial by jury existed also in the Roman Republic, though this was abolished under the emperors. Later, King Henry III of England provided for the accused to be judged by his neighbors. It was felt that since they knew the accused, their judgment would be fairer than procedures in which he tried to prove his innocence by combat or by surviving some ordeal. As time went by, the jury system changed into an arrangement whereby a group of citizens were to hear a case and reach a verdict based on evidence. A professional judge guided them on points of evidence.

    There is variety in the types of juries, the number of jurors, and what is involved in reaching a verdict. For example, in the United States, a grand jury of from 12 to 23 members decides whether there is enough evidence for a person to be indicted for a criminal offense; it does not determine guilt or innocence. Similarly, in a coroner’s jury (jury of inquest), the jurors weigh evidence to decide whether a crime was committed.

    When most people think of a jury, they have in mind a panel of 12 citizens at a trial—either a civil dispute or a criminal case—who hear testimony to decide guilt or innocence. This is a petit (small) jury, in contrast with a grand jury. Generally, the court sends notices to appear for jury duty to individuals selected from lists of voters, licensed drivers, or the like. Some may automatically be disqualified, such as convicted felons and the mentally incompetent. Depending on local law, others—such as doctors, clergymen, lawyers, or owners of small businesses—may claim exemption. (Some may be exempted because they have strong personal, conscientious objections to jury service.) Yet, authorities are increasingly eliminating exemptions so that all are obliged to report for jury duty, perhaps repeatedly over the years.

    Not all reporting for jury duty necessarily sit as jurors in a trial. From a pool of persons called for jury duty, some are selected at random as potential jurors for a particular case. Then the judge identifies the parties and their attorneys and describes the nature of the case. He and the attorneys examine each potential juror. This is the time to speak up if one has a conscientious reason for not serving because of the nature of that case.

    The group needs to be reduced to the number who will actually sit through the trial of that case. The judge will dismiss any whose impartiality may be questioned because of possible interest in the case. Also, the attorneys for each side have the prerogative to dismiss a few jurors. Any who are dismissed from that jury panel return to the jury pool to await random selection for other cases. Some Christians in this situation have used the time to do informal witnessing. After a number of days, a person’s jury duty is fulfilled, whether he has actually sat as a juror or not.

    Christians strive ‘to mind their own business,’ not getting involved in "other people’s matters." (1 Thessalonians 4:11; 1 Peter 4:15) When a Jew asked Jesus to judge a matter about inheritance, he responded: "Man, who appointed me judge or apportioner over you persons?" (Luke 12:13, 14) Jesus came to declare the Kingdom good news, not to arbitrate legal matters. (Luke 4:18, 43) Jesus’ response may have moved the man to use the method for settling disputes that was set out in God’s Law. (Deuteronomy 1:16, 17) Valid as such points are, responding to a direction to report for jury duty is different from involving oneself in the business of others. It is closer to the situation of Daniel’s three companions. The Babylonian government commanded them to report to the plain of Dura, and their doing so did not violate God’s Law. What they did thereafter was another matter, as the Bible shows.—Daniel 3:16-18.

    After God’s servants ceased to be under the Mosaic Law, they had to deal with secular courts in various lands. The apostle Paul urged "holy ones" in Corinth to settle differences within the congregation. While referring to the judiciary of secular courts as "unrighteous men," Paul did not deny that such had a place in handling secular affairs. (1 Corinthians 6:1) He defended himself in the Roman judicial setting, even appealing his case to Caesar. It is not as if secular courts are fundamentally wrong.—Acts 24:10; 25:10, 11.

    Secular courts are a function of "the superior authorities." Such "stand placed in their relative positions by God," and they make and enforce laws. Paul wrote: "It is God’s minister to you for your good. But if you are doing what is bad, be in fear: for it is not without purpose that it bears the sword; for it is God’s minister, an avenger to express wrath upon the one practicing what is bad." Christians do not ‘oppose the authority’ as it carries out such legal functions, for they do not want to ‘take a stand against it’ and receive judgment.—Romans 13:1-4; Titus 3:1.

    In balancing factors, Christians should consider whether they can submit to certain demands made by Caesar. Paul counseled: "Render to all [the superior authorities] their dues, to him who calls for the tax, the tax; to him who calls for the tribute, the tribute; to him who calls for fear, such fear." (Romans 13:7) That is straightforward as to a monetary tax. (Matthew 22:17-21) If Caesar says that citizens must give of their time and efforts to clean roads or perform other work that is among Caesar’s functions, each Christian must decide whether to submit.—Matthew 5:41.

    Some Christians have viewed jury service as rendering to Caesar what belongs to Caesar. (Luke 20:25) In jury duty the task is to hear evidence and offer an honest opinion on points of fact or law. For example, on a grand jury, the jurors decide whether the evidence warrants someone’s being brought to trial; they do not determine guilt. What of a common trial? In a civil case, the jury might award damages or compensation. In a criminal case, they are to determine whether the evidence supports a guilty verdict. Sometimes they recommend which sentence stipulated by law should be applied. Then the government uses its authority "to express wrath upon the one practicing what is bad," or "to inflict punishment on evildoers."—1 Peter 2:14.

    What if a Christian does not feel that his conscience permits him to serve on a particular jury? The Bible does not mention jury duty, so he cannot say, ‘It is against my religion to serve on any jury.’ Depending on the case, he might state that serving on the jury for a particular case is against his personal conscience. That might be so if a case involves sexual immorality, abortion, manslaughter, or another issue on which his thinking is shaped by Bible knowledge, not by mere secular law. In reality, though, it is quite possible that the trial he is selected for does not involve such issues.

    A mature Christian would also reflect on whether he would share any responsibility for the sentence rendered by judges. (Compare Genesis 39:17-20; 1 Timothy 5:22.) If a guilty verdict is in error and the death penalty is imposed, would a Christian on the jury share bloodguilt? (Exodus 22:2; Deuteronomy 21:8; 22:8; Jeremiah 2:34; Matthew 23:35; Acts 18:6) At Jesus’ trial Pilate wanted to be "innocent of the blood of this man." The Jews readily said: "His blood come upon us and upon our children."—Matthew 27:24, 25.

    If a Christian reported for jury duty, as directed by the government, but because of his personal conscience declined to serve on a particular case despite the insistence of the judge, the Christian should be prepared to face the consequences—be that a fine or imprisonment.—1 Peter 2:19.

    In the final analysis, each Christian faced with jury duty must determine what course to follow, based on his understanding of the Bible and his own conscience. Some Christians have reported for jury duty and have served on certain juries. Others have felt compelled to decline even in the face of punishment. Each Christian has to decide for himself what he will do, and others should not criticize his decision.—Galatians 6:5.

    See I was always told we were never to do jury duty....as people we didnt have the right to judge whether that person was guilty or not. Apparently that has changed as only a few months a go my elder dad got selected and sat on jury duty. When i questioned him on this he said it is now a matter of conscience. I love how things after a while can become a matter of conscience es

    funny how this applies to jury service but doesnt apply to judicial commitees...or to individuals who judge on the basis of jcs making wrong decisions

    I've been called 3 times since I started voting about 15 years ago. 1 time it was in the way of work so my employer got me out of it. 2nd time my doctor signed off for me, she didn't think I could handle the stress. 3rd time I sat and read a book all day until 1/2 hour before going home.

    I was called in for juror selection for a hospital wrongful injury suit where a person became injured surgery and was developmentally disabled because of it. I was not selected because I had a neice that something similar happened to. I was dismissed.

    I feel it is my responsibility as a citizen to vote, and my responsibility to sit on a jury if called. The underscore to my rights as a citizen.

    No, I've never been asked.

    A mate of mine volunteers for those police line ups where someone has to pick the guy who did it. Except one day this guy from where we worked was doing the picking and said, "hey what's he doing in there???!!!"

    Don't you know the society doesn't want you serving on Jury's? Imagine if you experienced how justice is served in real life situations and realised that the justice metered out from the platform, backroom, publications was all a crock!!!

    I was picked for jury duty for a domestic violence case and I said "I am one of JW and I do not believe I am in a position to judge others". The judge let me stay, but the prosecution dumped me.

    I would love to sit on a jury. I just got a new job working for a govnerment entity and if I get called I would receive my full salary for serving on a jury. Hope I get picked soon.

    i learnt this by fighting a traffic violation...and at the end of it...which i won...i remember thinking..wow justice from an arrangement run by the devil...

    the irony just knocked me out
