I actually don't know what the fuss is about, other than their claim they didn't know the policy about breaks was going to be enforced.
They were given breaks and instead they chose to pray while on the clock. I would like to do personal things during my paid time too, but I realize it's not my right.
I think it had more to do with the fact that the rule was never enforced, and then it was without warning. My mom drives for their company and honestly, they spend most of their time not working anyway-praying isn't going to set the company back any, which is why no one bothered enforcing it before-it simply never infringed on the work to be done. Now, I would think that there is someone there who is either just legalistic or who wants to have an excuse to get rid of the Muslims. You know, a new, enthusiastic manager who thinks that by doing everything by the book that he will have success.
Or, I could be wrong and that particular operation is wildly busy, they don't stand around BSing all day and smoking while they wait for the next batch of cars to get off the dock or the driver to come and get them or for their boss to have the manifest ready and a plan for the next run. My mom has done that for 12 years or so. They have people working for them on oxygen, who have seizures (I shit you not!) and who sexually harrass each other on a regular basis. They have bigger issues than people PRAYING while they wait for the van.
I have to apologize, my mom works for the car rental portion of the business, she isn't a shuttle driver. I read an article earlier that seemed a little different, so please forgive me. My mom only WISHES that her job were union!

No, they can't.
Most of these people have worked for Hertz for years with no problems, and the issue isn't money because they were paid for their breaks. The issue is that the union was never notified that Hertz was going to take any action; Hertz just started firing people for behavior that had previously been acceptable.
To me it doesn't matter if it had been ok previously. Rules change. You have to go with the flow if you wanna stay employed. At the hospital I worked at, they used to have a little smoking shelter just outside the hospital. Then the hospital went totally smoke-free. Meaning you can't smoke anywhere on their property, even in your car if it is sitting in their lot. That means the smokers had to leave hospital property to smoke. If you didn't comply, there were consequences.
As a Witness, I knew there were certain jobs I just could not work and "maintain my integrity " so I just never applied for those jobs. Basically, if you can't fulfill your religious obligations on a specific job and you can't see yourself being able to compromise, then it's time for you to quit.
