I'm surprised that no one has yet been able to provide us with an answer to this question.

There are plenty of ex-elders on here, one of them is bound to know the answer.

All the elders cared about was that she had been DF'd once before for having sex, she was out drinking with friends when it happened, and she was wearing sexy clothes.

Not that just makes me sick! And where is the love from these elders?

Fat.. I have seen at least one BOE refuse a "worldy" person to speak as the proverbial second witness. This wasnt a rape, more of a civil (fraud) type matter.

We have also seen the courts convict rapist/molesters on "hi-tech" evididence and the WTBTS refuse to disfellowship the perp...and then turn on the victim who reported the crime.

Getting a BOE to look into forensic evidence... the odds are fairys will fly from my butt before that ever happens.

Very disturbing to think you would do such a thing... yet at the same time I am somehow turned on by it.

That happened in my case. My worldly grandmother and aunt were willing to tell the elders what they knew about my father and grandfather. The elders told me, and the CO later backed them up, that "worldly people don't count" (exact quote). When I asked why, I was told that since they are not Jehovah's Witnesses, they could not be trusted to tell the truth (like my father could!)

When I left in 1989, the rule was that there had to be 2 eyewitnesses and those 2 eyewitnesses had to be baptized Jehovah's Witnesses preferably in good standing. To the best of my knowledge that has not changed. I have not seen nor heard of anything from the Society altering this stance in the past 17 years. However to be fair, I do not know that with 100% certainty.

In the one case I had to handle we never questioned the truth of the statement of rape but assumed it was true and focussed on the alleged victims obligation to scream and try to get away. Almost took judicial action against the victim for their passive resistence.

just2laws, how long ago was this?

I think that the Brooklyn braintrust has gone back to this direction, if the last WT on it is any indication.

I suspect that the WTS does not consider DNA and other pieces of information that would support a case of rape is because the elders are not lawyers. They do not use the legal systems that are in place. The use their own records that they consider higher than the laws of the world

Their role is not a legal one but rather a spiritual/legalistic role with the heavier emphasis on the spiritual part Their attention is on how the action appears to outsiders and if it became known how would people view the JWs. Their focus is always to protect the organization from scandal.

What is really sad is that the victims pay the price for their "clean" reputation.

What is absurd is that in their insistance on protecting an organization's reputation they are really making themselves out to be uncaring, unsympathetic and archaic. FOOLS

Men, keeping it a male-dominated environment where women and children have few or no rights.

They sure know how to use the legal system to their advantage, further more while the elders are not laywers , they do but gather evidence to judge you. Seems very legalisticly modern to me.
