Watchtower publications and Copyright Law

    In the past, I have told my friends that if I were not in the industry in which I am employed today, I would have been an attorney. To me, law has always been an intriguing area to be involved in. Not only does researching information that pertains to personal matters teach you the basics on how to conduct yourself in court and the due process of what is involved, you also learn many various laws that may have been totally foreign to you beforehand.

    Many times on this site and on other personal websites across the globe, religious entities, or publishing corporations, have been a deciding factor in what is and what is not posted, copied, and presented. Specifically speaking, the Watchtower Bible and Tract Society is one formidable opponent when dealing with copyright issues. No one here has the legal weight, representation, or deep pockets that the Society has. Of course, in dealing with minor peons, as the Society looks upon us all as, She can throw her legal weight around with such force that can keep one tied up in court for weeks or years while draining whatever funds you may have. Just look at the effort expended in keeping the Flock book off of the web. Jail time is even a possibility.

    So what is allowed to be posted on the web? Most of us already know about "fair use" laws and how much or how little can be posted from the publications. It really is open to interpretation considering the amount of literature which the Society has printed over the years. What I would like to open for discussion is: Which publications can be reproduced in their entirety on the web or on other media formats? And where does the line become gray with regards to certain publications printed in particular years? I will attempt to answer these two questions with the second one creating a possible dilema for the Society to confront.

    What is legal to present in whole form from the Society's publications? That's easy. Any publication which was formally copyrighted prior to Jan. 1, 1923. In fact, all previously copyrighted material which predates Jan. 1, 1923 is considered to be in the Public Domain. Material which is in the Public Domain can be freely copied and distributed in any manner in which you see fit.

    Publications created after Jan. 1, 1923 is the gray area. Any publication that was published without a formal copyright notice prior to 1978 immediately went into the Public Domain. This would require checking every publication to make sure whether or not a formal copyright was issued. Works published in and after 1923 and before the end of 1964 with a formal copyright notice would have entered the Public Domain after the first term of twenty-eight years, unless the copyrights were renewed. This is another area in which more research is needed. All publications from 1923-1964 should be verified with the U.S. Copyright Office to see if they were ever renewed. If they were not, these publications are now in the Public Domain. Works published between 1978 and 1989 with a missing or defective copyright notice which were not corrected entered the Public Domain upon publication. You could always try to use material from the publications and force the Society to prove they have a current copyright.

    Of course, this type of research could take many days or weeks to accomplish. If you can get through on the Copyright Office's website, more power to you. Whenever I try to use the search function, it is always busy or unavailable. Just go to:

    As of moments ago, the copyright office lists ONLY 222 items that are registered with the copyright office. Any old publications should be listed here if they were re-registered. There are none.

    Apart from the legalities of copyright law and enforcement, I would like to compare the WTS with an even 'mightier' opponent: Hollywood.

    The movie and music industry is really floundering when it comes up against the new technology like peer-to-peer file sharing so just as this hurts hollywood and is impossible for it to control, so people copying and sharing WTS works digitally may be impossible for them to control and just as damaging.

    The genie is very hard to put back in the bottle once it is out.

    Just look at the effort expended in keeping the Flock book off of the web. Jail time is even a possibility.

    I had it in mind to start posting some of the flock book on here so ppl could see Elders instructions on how to go about handling matters, are you saying I could get in trouble for that? And where is that information available?

    My take on this is from the first paragraph:

    The Supreme Court on Wednesday upheld longstanding copyrights designed to protect the profits of songs, books and cartoon characters, a huge victory for Disney and other companies.

    So, if copyright laws are "designed to protect the profits", and the WTBS is a "non profit" organization...

    Are their books/publications "given" or "sold"?

    Other than having "something to hide", why should the WTBS care if their publications are "given freely"? Seems to me that it would help to spread "the good news of the kingdom"....

    That is the true question in all of this. Since the WT pulications are supposed to be 'without charge' on a donation arrangement, why would a non-profit org care if their works were copied and redistributed. After all, aren't they trying to spread their 'message' to as many people as possible?

    Of course we all know why they don't want (especially certain works) their stuff republished. Too easy for those evil apostates to get ahold of, and most of all, there would be no pressure at all to donate to the 'worldwide preaching work'. If they truely did not care about the 'profits' they would not mind their works being copied.

    edit: think of the savings - in a single congo, Bro Joe Computer could copy the WT CD for his buds, thus making the WT only have to produce one CD instead of, say, 35 or so. It would save them lot's of $$ - of course, then all of Joe's buds would not drop their 'suggested' $50 in the box. <slaps wrist> Bad Brother Joe Computer!
