If you shot someone stood on a ledge threatening to commit suicide you would still be guilty of murder.
He shot someone, the fact that they died as a result depends on so many factors including the traffic conditions and how long it may take for an ambulance to respond. Nothing absolves him of the crime, it's just an attempt by a defense lawyer to try and confuse the issue.
