    wha happened --- I strongly agree!

    It's how I already felt, but your definitions convinced me that I am right, especially this one ---> Third degree: killing that resulted from indifference or negligence. Usually there must be a legal duty (parent - child), but can also include crimes like driving drunk and causing a fatal accident.

    This doctor was NEGLIGENT .. he took the 'golden handshake' from MJ, and forfeited his right to claim that he abided by the "Hyppocratic Oath". He KNEW what he was doing was contra-indicated by the 'rules' of medicine, and he also KNEW that he was participating in a procedure that could cause DEATH.

    He enabled a sick person, to engage in a life-threatening procedure. He is GUILTY of more than 'accidental manslaughter'. He knew better.

    They say that about the most actual jail time he would do in California is about 4-6 months for a four year sentence due to the overcrowding issue.

    He will almost certainly lose his medical license.

    JamesWoods ,,, well, at least he will lose his license. I hear he will only go to 'county',,,, in Canada, a 4-year sentence will put you in the pen, which is where I think he belongs.

    No matter how one feels about MJ, this "DOCTOR" cared more about the almighty dollar that he did his 'patient', and the oath he took as a physician, and he deserves everything he gets.

    Truth be told, I do NOT believe prisons should exist. Within our system, that is the only 'punishment' this doctor could receive, so I support it.

    Before you say,,, why not prison? ,,, I'll answer .... why not put him to WORK in a free clinic for 4 years? Make him pay HUGE reparations to perhaps, homeless shelters ...

    I don't want to be a hypocrite, so just wanted to say,,, prison is NOT the answer! Prison is torture. I realize some may disagree, and that's okay. I'm not interested in debating the issue. It's okay if you feel differently, that's your right.

    I don't think putting incompetent/negligent/reckless doctors in charge of fee health care is the solution to a problem.

    I'm guessing the prosecutors charged him with the highest crime they thought they could get a conviction on.

    lol @ James... :) That was an 'example' of an alternative to prison, which I am strongly against --- neither humans nor animals s/b caged.

    But,, more to the current point,,, it has not been said that he's a 'lousy doctor',,, he's just so GREEDY that he offered himself up as a 'gun for hire',,, and did exactly what he was told, not what his professional ethics dictated.

    ( PS, if you wish to debate that topic (ie, prison), I'd be happy to, on another thread. :D )

    If he writes a book, it will have to be AFTER he serves, as the US law states that prisoners may not profit from the proceeds of their crime,, and at the very least, that's a good thing.

    HOWEVER,,, I think that $$$$ was the problem ...

    If he was put to work in a free clinic, that is a whole different matter.

    He has not been judged incompetent ---- negligent (money) and reckless (money) yes,,, but not incompetent.
