    I do civil rights law so I only passing knowledge of "piercing the corporate veil." Certainly, the concepts have expanded or contracted since law school. It struck me as a field that only specialists should deal with in practice. Concepts seemed muddled to me. The basic rule is to favor the corporate structure. Australia is a different country. The basics may be the same b/c both the US and Australia were British colonies.

    More is involved than minimum contacts in piercing the veil. Minimum contacts consistent with US due process may be read differently in Australia which may define due process and personal jurisdiction differently. As a Beatles fan, I am proud that minimum contacts in NY were cemented by the Beatles litigation against their former manager (save Paul who had his father-in-law). Special consultants were hired. They were told never to step foot in NYC. George missed a friend and trusted his close friends. As soon as he knocked on his Manhattan's friend's door, the process servers grabbed him. Years of litigation down the drain. Finally, Ringo Starr was the only one who was a good client and stayed away from NYC. In a landmark case, the court noted the hundreds of millions of records sold in NYC, affiliated corporate officers, recording studios used, etc. and found that an individual can do business in a state to warrant personal jurisdiction. Yoko fired the Harvard/Yale large firms involved and hired a grunt lawyer from a local school. He did a superb job.

    On a side note, how do we even know that the specific legal entity known as CCJW actually did anything in Australia? Since it was created specificially to deal with U.S. congregations, wouldn't congregations in Australia be handled by one of the other legal entities?

    The answer to that question is "we don't know yet, but Mr. Unthank and the Australian branch and congregation elders do" and that is one of the things this trial is going to answer. It is one of the things that makes this important. The primary importance of this case is to protect children from the Watchtower's pedophile protection rules. The secondary importance is to get documentation of where the organizations various entities stand in relation to each other.

    Teary, I honestly hope that one day you sit down, clear your head, and just read the Gospels without any preconceived notions. If you do so with an open heart I bet you anything you there will be some small part of you deep down somewhere that will force you to step outside of yourself for a moment, look at the Watchtower organization and all of the legalistic, corporate, beauracratic madness that has utterly consumed it, and it will all fall away like chaff from wheat - or scales from your eyes - and the only thing you'll be able to see is the radiant personage of Jesus of Nazareth, and that none of that stuff has a tinker's damn to do with Him.

    It's happening, very slowly, one by one, to people in the Org, and that's why the GB is freaking out and losing control. Don't make the same mistake I did. Listen to His voice, drop the Watchtower/Governing Body/Faithful Slave, and run to him before you become an ever crustier, bitter-er old fart like me.

    One does wonder though, why the Watchtower Bible and tract society of Australia was not included in the action by Steven Unthank.

    And we will never know, if HE does not make it clear to us.

    I would hope that it was not a oversight in his case, although he must have researched all the various entities before going in...

    The WTBTS of Australia WAS included in the action. They were the ONLY entity with a lawyer in the previous hearings.

    I thought Barbara Anderson in an earlier post reported that a female lawyer appeared and represented all parties to the suit. This is very odd strategy. It makes no sense. I posted about it at the time. It doesn't help stop jurisdiction over the American entities to acknowledge that all is one happy family with common purpose.

    I wish the actual legal pleadings could be posted.

    That is probably because the WTBTS of Australia was the ONLY rational, non-jurisdictionally challenged, non-symbolic party that Unthank called, so they didn't need more than one lawyer.
