Changes in Australian legislation - likely to outlaw shunning in the future?

    New domestic violence laws will make it an offence to harm pets, cut people off from their family or withhold financial support. The changes to the Family Law Act were passed in December but come into effect this week. They expand the definition of domestic violence to more than just physical harm, such as denying a family member financial autonomy or the money required to meet reasonable living expenses.

    The changes also include emotional abuse and preventing a person from maintaining contact with family, friends or their culture. The Salvation Army's Major Andrew Craib says the changes recognise that it is not just physical acts of violence that can harm children. "They might see a perpetrator constantly putting people down.

    Often people hear that enough and they begin to believe that for themselves and that's unacceptable in our society," he said. Mr Craib also says the changes are a reflection of society's rejection of domestic violence. He hopes the changes will encourage more victims to seek help. "They're more likely to feel now that somebody has an understanding of the circumstances that they're putting up with," he said. "I would hope that that gives them a bit of confidence and reassurance that people are actually going to hear them and believe them and that some action is going to come about that's going to bring both their safety and that of their children."

    It is about time emotional abuse gets fully recognized. The problem that I see is that they can't handle the physical abuse cases now. There just aren't enough services. Now that problem will increase ten fold as victims of emotional abuse begin to step forward. What they are going to need to get them stepping forward though is an excellent educational program to help people understand the negative imapct of emotional abuse.

    Should also be interesting to see how this plays into the emotional abuse perpetrated by cults.

    I first had this issue brought to my attention by relatives in Australia.

    I'm no legal expert, and it seems a stretch to suggest that this change will make shunning illegal straight away. However, one could easily imagine a scenario whereby a future victim of shunning in Australia with money to spend takes the Society to court over "emotional abuse" and wins. Or is that just wishful thinking?

    Would be nice, I just don't see it. You have the freedom to shun anyone you want. You don't need to be friends with people you don't like or people that did something to you, I don't see us living in a society where a government will dictate to us how we should act towards others in this respect. When it comes to dub shunning, this could fall under the same technicality as blood not being a df offense. "We don't shun people, if someone chooses to do something offensive to us we are under no obligation to continue to be their friends. So if these individuals view us as shunning them that is their perspective." Not being a JW could be deemed offensive to dubs which automatically triggers the shunning response. After all, when they announce so and so no longer being a JW, they never mention that dubs should shun them - cult members automatically know what it means. Lets remember, that cults do twist words and interpret things for members differently than the society in general would, while the followers eat it up without a question - definition of generation is a prime example of this.

    The only hope is that governments finally recognize wts as being a cult and categorize them as such, strip them of charitable status and start taxing them like any other corporation.

    Hi Cedars, Thanks for posting this change in Australian Law. Go Aussies!! It will be interesting to see how the Aussies enforce the new law.

    Personally, I think it would be more economical for the Aussie government to go after organizations that promote shunning to their members. Government should revoke a non-profit organization's charitable status and/or tax exemption status for promoting shunning to its members like I'm trying to petition the President of the U.S. to encourage Congress to enact legislation in the thread http://www.jehovahs-witness.net/watchtower/beliefs/226465/1/Its-Back-Round-2.

    I have wondered why U.S. citizens could not sue the Society for "Alienation of affection" or the like.

    I do know that when some have threatened a lawsuit against the WT if they were disfellowshipped, they were not df'd (shunned, but not df'd).

    Thanks for the link Cedars.

    In my case i didnt really know my rights when i was disfellowshiped. had i been in possesion of the Elders secret book i would have threatened Legal action against the Congregation and the Watchtower society which would have made them back off and review my case without biased views of some back stabbing elders. Never mind i wouldnt be free if that had happened.

    In the space of 1 and a half years i have spent the total of maybe 1 hour in contact wih my children thanks to that religion. Any law that could help to stop splitting families up is surely in the public interest in Australia and other countries as well as family is a basic right of Humankind.

    Azazel - wow, I had no idea that shunning has taken such a dreadful toll on your own family circumstances. I do feel for you.

    I can only hope that this change of legislation will eventually prove to be a Trojan horse for the Society, at least in Australia. It may be wishful thinking, but there's nothing wrong with that.

    I imagine there will end up being a few test cases, but wouldn't hold my breath for good outcomes. Take the bullying laws for example. much is made in the media and by the government about how fantastic the laws are, when the reality is far far different, in some recent australian landmark cases the magistrates threw the cases out or allowed worksafe victoria to bog it down in a morass of legal mumbo jumbo until it came to nothing.

    its not about doing the right thing, it's about looking like doing the right thing.

    Boy can I see a lot of problems with that..

    Really the last two..how can they ever think that can be enforced?
