In case somebody wants to read case documents:

EFF's motion is available on the Foundation's site (see the link Zindagi posted above), and other documents can be found here: https://www.courtlistener.com/docket/8509534/in-re-dmca-subpoena-to-reddit-inc/

    Simon is right.

Fair use is a *defense* not a *license*.

The only way to claim something is "fair use" is in a court of law after being sued for copyright.

"Fair use" defense prevents lawsuits, though, in the sense that any reasonable lawyer will tell their client they're wasting money and risking a countersuit.

But, as we know, the lawyers working for Watchtower don't care about reasonableness.

Reddit have their own reasons for not wishing to comply with Watchtower and provide the users information

Exactly. They are, frankly, one of the "leech" sites on the internet where they profit from encouraging copyright violation and so they want to defend it. They honestly don't give a rats ass about you, your freedoms or any principle - if it suited them better to hand you over to the gestapo, guess where your new home would be ...

While that is true, they do have a good record when it comes to copyright and takedowns and my experience is that they don't appear to overreach. If you host files / copies then you are more likely to get a DMCA takedown notice vs if you discuss or critique things (more obviously in the "fair use" scenario).
