The elders manual says it can be, if it is "an entrenched practice of viewing, perhaps over a considerable period of time". That is classed as "gross uncleanness with greediness".

So, if you are only an "occasional" viewer, then it would not be judicial.

Yes I know it is a crime. There is not a particularly lot of overlap in the Venn diagram of "judicial matters" vs. "crime".

The Shepherd The Flock secret elders manual in chapter 5 par. 14 states:

"Though this is not an exhaustive list, gross uncleanness may be involved in the following: An entrenched practice of viewing, perhaps for years, abhorrent forms of pornography, that is sexually degrading. Such pornography may include. . .child pornography. Brazen conduct would be involved if the offender was promoting such material, such as by inviting others to view it, thus giving evidence of a brazen attitude."

And there is the get out of jail free card. Child porn only may be gross uncleanness, and if one were not promoting it with others then it likely would not rise to the level of brazen conduct which is the fall back, catch-all excuse to DF anyone for any reason that three judgmental elders can cook up amongst themselves. Just shows the Borg's thought process for excusing child sexual assault as only a judicial sin rather than a legal crime.

Of course the whole judicial system of the JW is different from the world in that nothing carries an automatic penalty. It is there to root out the unrepentant. However this guy would have an awful lot of explaining to do ………

There was a case, I think maybe 10-12 years ago, a JW MS was caught doing something sexual & illegal, and was arrested - it was in many news reports. I definitely recall, as posted on this forum, Bethel directed the elders go to the prison where he was being kept after arrest and they DF'ed him on the spot.

Pretty much, I suspect, so they could truthfully say, when asked by the press, "Him? He's a former member!"

It's often said that there is only one df-ing offence, that of not being repentant. It's very possible for a JC to find that a person used child porn but the elders feel that he was repentant for it and so not df'd.
