I personally think they should have charged him with manslaughter. Once everything comes out in court, and in light of the existing law it may be difficult to get a jury to convict him on 2nd degree murder.

My understanding is they always go for above what they hope to get.
I was on a murder trial a couple of years ago, we had to decide what to convict him of. Once we decided murder, it was pure hell choosing between first or second.

Should have been charged with aggravated assault with a deadly weapon and manslaughter.
Prosecution may have 2nd degree murder stick in this case .

Second Degree Murder is a murder that is not premeditated or planned in advance.
Voluntary Manslaughter sometimes called a "Heat of Passion" murder, is any intentional killing that involved no prior intent to kill, and which was committed under such circumstances that would "cause a reasonable person to become emotionally or mentally disturbed." Both this and second degree murder are committed on the spot, but the two differ in the magnitude of the circumstances surrounding the crime. For example, a bar fight that results in death would ordinarily constitute second degree murder. If that same bar fight stemmed from a discovery of infidelity, however, it may be mitigated to voluntary manslaughter.

This guy thought "in the moment", and did a terrible thing ............. he will have to live the rest of his life with that.
A young boy is dead. Maybe it's time we thought LONG and HARD about how we see 'others'.
