There is a need to let people know the courts are serious about punishing bigotry, that way the otherwise good citizen dad won't find himslef locked up for a stupid moment on a Saturday afternoon.

That is one of the reasons why the Americans adopted the 1st amendment in their constitution in the first place, because giving any single person or group of persons power like that will inevitably lead to abuse and supression.
The 1st ammendment allows white supremisists to spew racial abuse at black people or Jews while the police are powerless to act.
