    A Superior Court judge has ruled that a Jehovah's Witness church in Boston can be sued for breaking its trust and legal duty to a girl who said she was sexually abused by one of the church's ministerial servants.

    Suffolk Superior Court Judge Herman Smith Jr.'s ruling is believed to be the first time a Massachusetts court has determined that church officials have a "fiduciary duty" to members of their congregation, a relationship akin to the one lawyers and doctors share with clients and patients.

    Smith's ruling, made earlier this month, also is expected to open another legal channel for lawyers to bring civil suits against churches for clergy abuse cases, according to Lisa Bruno, news editor for Massachusetts Lawyers Weekly.

    "It gives another piece of ammunition to plaintiffs, another grounds for finding a church liable for the actions of priests and ministers," Bruno said.

    Carmen Durso, a Boston lawyer who settled 40 lawsuits against the Archdiocese of Boston in 2003, said he expects Smith's ruling to pave the way for more clergy abuse cases to proceed.

    "It affords another basis, a stronger basis, for bringing claims against churches in sex abuse cases," Durso said.

    The girl at the center of Smith's ruling was between 9 and 11 when a ministerial servant with the Columbus Park Congregation of Jehovah's Witnesses allegedly molested her during Bible study classes in her home, Lawyers Weekly reported.

    The girl's parents, who learned about the alleged abuse in August 2000, sued the ministerial servant and two Boston-area Jehovah's Witness congregations for negligence as well as breach of fiduciary duty. alt

    What will the WTS do now to entice bros to become elders?
    Are they making promises that they will back them up if they follow the letter of the law? I'm just thinking that if I was an elder and I could be sued for following the WTS dictates, and they would not help me, ie , provide legal counsel for free, why would I want to be an elder? (Note they do provide help with child custody cases, but do to know the charge.)The WTS has always found ways to get around legal things, they just get their lawyers to "out legal" the next guys. We have seen that with the donation arrangement, the changing to DA for a lot of offenses.

    Now if only some smart lawyer will come up with a way around mental, psychological, emotional abuse. God, there has got to be a way to beat these evil people.(at least that is my prayer)

    also, while the doc /pt and lawyer relationship are recognized, it's fairly easy for the professional to void that relationship and then not be responsible for anything. I posted this on another thread , hope it is OK to post it again. weds

    If it hit's there pocket book, they will do what they always do, see new light,. It will be gods will for elders and ms's to tell the authorities about sex abuse. the tower is all about the bottom line, they are tight when they come to giving out any dollars. I guess god cant multiply the talants

    They have said in writing in confidential, private letters to the body of elders that they will not back your play if you are sued, and visiting CO's have also made it clear, on behalf of the WTS, that if a local body or individual elders are sued, the WTS will NOT step in and assist (altho, as stated above, they will intercede in child custody cases, but that's different).

    In one congo I served in, each time there was a meeting to discuss forming a judicial committee a very wealthy elder always bowed out of consideration if the accused publisher made any kind of legal threat or if the incident appeared controversial in any way. He told me privately that he had too much to lose and that the WTS' decision to leave us on our own had made him reluctant to serve on a JC. He knew he couldn't decline to serve on all such committees, so he felt he was forced to pick and choose. He would only serve on ones that were cut and dried, involving publishers who were meek and/or lacked legal savvy.

    Even then, he was terrified that some unseen controversy would erupt in the course of the hearing and he made it clear (to me and a few other elders) that if the threat of legal action ever came up in a hearing, he would not be able to vote to DF and would have to be replaced on the committee. Some of the elders were pissed about this, but no incident occured and no organizational stink was ever made about him. He continues to serve to this day, his fortune still intact.

    That's excellent news. Guys like your rich elder are helping our cause. All we need is

    one good legal precedent set in regard to DF'ing and this stupid arrangement is toast.

    No way does the WTS, want any bloody clothes laid at their feet.

    They take great pains to distance themselves, from the actions of the elders, whispering from behind the scenes so to speak, with their secret, non copiable letters and verbal messages,, using messengers to convey their instructions.

    If a body of elders got sued, no way, even in secrecy, could they give them any support, because if it became known, it would indicate that they definitely are the ones responsible.

    Elders, you are expendable. You are on your own, buddies.

    Don't expect an exodus out of the servant body. Most of the elders are too enamored with their 'privileges' to think it all may come back to bite them in the rear end one day.
