Judicial Hearing-Elders Afraid

    After my specific request in writing of not being able to attend unless my witnesses could appear, the judicial committee informed a reporter for the Paducah Sun they were going to convene a hearing anyway at 7 pm Wednesday evening. I decided to go down to the Kingdom Hall and make an appearance. I arrived at 7:05 and parked out front . The Sun reporter was there, but I noted there was only one vehicle in the parking lot. Now as you may recall, to convict a child molester in the face of a denial there must be two eye-witnesses before a disfellowshipment can take place. Since I have flatly denied the charge of "causing divisions" I chose to wait for any witnesses to appear to testify against me. None showed up. After the reporter left the elders peeked out the window and saw me sitting out side, then the strangest thing happened, they taped trash bags over the windows and it appears they locked the front door. I took a picture as elder Jeff Stein stepped outside to do so. (You have to lock the door from the outside)I waited for another thirty minutes and then all three came outside, Ron Cary, George Bandarra, and Jeff Stein. Jeff waved and they got in their SUV and drove off.

    George Bandarra informed the Sun reporter they were going to call me with their decision Thursday. I do not understand how they made a decision for the following reasons:

    1. They produced no eye-witnesses in the face of my flat denial.

    2. They ignored my request in writing for my right to produce eye-witnesses as to my innocence. (this is according to organizational protocol)

    3. They did not invite me in to appear, but instead covered the windows and locked the door even though I was sitting in plain sight.

    4. They refuse to acknowledge or answer any correspondence I send to them but act on their letters without any consideration for my defense.

    IN this photo if you look closely you will see the windows are open on each side of the door and a reporter from the Sun is inside talking to the elders.

    There you have it windows taped completely shut and door locked. I guess this will really help them to meditate on making a fair and impartial decision.

Perhaps because they forgot their eye-witnesses they did not want to talk about it as I sat right in front of them. Could it be that once again these local-out-of-town elders gave in to "fear of man"? Perhaps they are blind and did not see me sitting in their driveway taking their picture?

    Why aren't they following their own protocol? Or did the 3 elders also serve as the "two witnesses"? Wouldn't that be a conflict of interests?

    That's crazy! This is like a Judge also witnessing against the accused before making his decision and to top it off having the trial in secret without the accused being there.Very unethical. Of course,since when did they have ethics!!!!

    I couldn't imagine, a judicial meeting about you...don't even let you in....why didn't they just go to

    Shoney's or something. Were they afraid you were going to lip read their decision? As if the outcome

    isn't already decided. Why did they even bother going thru the motions?

    Bill,

    If they do decide to DF you then your appeal hearing will be interesting. I am assuming that they will notify you of their decision and offer you the opportunity to appeal. However, since they appear not to follow the guidelines in the flock book who's to stay what procedure they intend to follow.

    I think they should be afraid!

    Handling Judicial Cases

    Do not send an individual any kind of correspondence
    that directly accuses him of specific wrongdoing.

    It is best for two elders to speak with the indlvidual and
    invite him to meet with the Judicial committee.

    Suitable arrangements should be made as to the time
    and place of the hearing.

    State what the person's course of action is supposed to
    have been.

    If it is necessary to send a written invitation, you should
    simply state what the individual's course is alleged to have
    been, the time and place of the hearing, and how the
    person can contact the chairman if the arrangements are
    inconvenient for him.

    If the accused wishes to bring witnesses who can speak
    in his defense regarding the matter, he may do so.

    However, observers are not permitted.

    No tape-recording devices are allowed.

    If the accused repeatedly fails to come to the hearing,
    the committee will proceed with the hearing but will not

    make a decision until evidence and any testimony by
    witnesses are considered.

    The committee should not take action against a person
    unless the evidence clearly proves this necessary.

    Failure to appear before the committee is not in itself
    proof of guilt.

    Sorry to hear that you're being treated this way Bill! However, as you know, the elders are getting their directives from the Big House; they probably don't know how to comply with the Big House's wishes since they're being asked to act contrary to the scriptures! Anyway, I've seen this same kind of crap before! This pains me greatly! Hang in there anyway! My prayers are with you and your wife! You'll remain in God's grace no doubt, for your steadfastness in support of abused ones! Keep on fighting!!!

    Bill...on a certain level, I feel great sadness to see/hear how these ' spiritul men ' are acting. For so long, to me, they represented all of a loving God's qualities. So sad. Principles will always monitor all our conduct. Peace to you, you brave soul.

    BILL, just face it ....you are going to get disfellowshipped. They are not going to keep you in the organization after all that's happened. It serves no purpose for you to stay any longer.The majority of Witnesses view you as a trouble-making apostate. When you are out, just do whatever you can to protect silentlambs, but realize, that you cannot effectively do anything in the congregation because of your standing. I wish you well,my brother.
