Sebastian Ramos case: Prosecutor appeals to Supreme Court of Justice

    The link below will find the documents submitted by the prosecutor in the state of Ceara, Brazil calling upon legal advice that the case of discrimination against the elders of Jehovah's Witnesses, is scanned again and taken to the Supreme Court in Brasilia. The ex-Witnesses are thrilled with what this may mean the national level as well as the possible coverage which may be either part of the media. Even if the appeal is without effect, a giant step was taken in the search for the criminalization of a religious body that causes much pain and humiliation to those who leave or forced to free and spontaneous will. It would be good if others could do the same, probably in a joint action in court rather than individually, which would have more relevance to justice. Many did not believe that this could get to the point it reached, are beginning to have hope that justice may rule favorably in a situation that violates the most basic human rights and deprives thousands of people their dignity, love and affection of their families and companionship of longtime friends.

    I've gotten a lot of leads on this case, many directly from someone claiming to be Sebastian Ramos. Unfortunately, much of the text explaining the background, activity, and status is is such broken English that it makes no sense to me.

    Can someone give me a better synopsis of what is going on in Brazil and how serious the uprising among JWs really is?

    This could be very big. If it was in the USA, Canada, or the EU everyone would have their ears tuned to, but being in South America, it has tended to lose the attention of the greater crown of ex-other sheep.

    Mesmo que não consigamos algo mais concreto no campo jurídico, já podemos nos contentar com o que já foi feito, e mas precisamente, no campo político. Portanto, conclamo, a dissidência brasileira a instalar outdoors em outras capitais do país para que as pessoas tenham o direito de conhecer os feitos do Escravo, haja visto, que as pessoas em sua esmagadora maioria estão alheio ao seu processo de discriminação que separa familias, casais e amigos.

    After that, there is a comment by a Ricardo Oliveira, who said the following:

    Li toda a fundamentação do recurso e vejo grandes chances de ele ser provido, afinal, o Tribunal de Justiça agiu precipitadamente ao extinguir a ação penal, pois o Desembargador Relator achou que era um "caso sem relevância" e extinguiu a ação sem que houvesse a fase de produção de provas, fase na qual as aberrações e discriminações ensinadas nas publicações da Torre de Vigia seriam comprovadas. Nem mesmo o Desembargador que extinguiu o processo tomou conhecimento das violações de direitos humanos sofridas pelos ex-tjs. Assim, não houve oportunidade de o juiz do caso saber das aberrações, segregações, discriminações praticadas pela organização e pelos seus membros porque não houve audiência das vítimas e produção de provas.

    It seems the case was dismissed without really analyzing it, and now that dismissal is being reversed.

    "Caso o STJ venha a dar decisão favorável ao Ministério Público que representa a dissidência, o habeas corpus concedido será anulado e o processo voltará ao juiz para que haja audiência de julgamento, onde as provas contra a Torre de Vigia serão efetivamente produzidas, testemunhas serão ouvidas e aí sim o juiz julgará o caso com provas concretas. As chances são grandes. O STJ, sendo o Tribunal da Cidadania, certamente aplicará as leis a este caso, ressalte-se o fato de que este caso trata de violação de direitos humanos. Se a decisão for favorável, abrirá um precedente para todos aqueles que um dia foram lesados pelas regras segregacionistas do corpo governante entrarem com a devida ação pleiteando a responsabilidade penal e civil dos membros da seita, ou seja, a dissidência terá jurisprudência em seu favor, na qual o STJ poderá sustentar outras decisões no mesmo sentido".

    Apparently there is no uprising. There is a group of people who were able to file a claim against the Watchtower (the Brazilian organization, maybe?) for segregation and discrimination. That could set a legal precedent that other Jehovah's witnesses might use against the Watchtower.

    I think that the fact that the Office of the Public Prosecutor of Ceará agreed to take the case is an evidence of legal, official support.

    Thank you DGP. That does seem to make things a little clearer. I will try to find more information about this issue and maybe give it a write-up on Ex-JW.com. It seems that's what these people want, because they keep sending me their comments and other documents in Portuguese. Some have partial translations, but as I said, they are basically unintelligible. Your translations are much clearer and provide a lot more information.
