The Constitutional Court yesterday reserved judgment in the case of four Jehovah’s Witness parents and guardians of pupils attending Anglican-orientated Arundel School who are challenging the school’s requirement of chapel attendance. Four parents — Amos Makani, Mbiri Shiripinda, Plaxedes Chipangura and Daniel Sakupwanya — hold beliefs different to those of other Christian denominations.They argued that compelling their children to attend chapel services violated their religious beliefs.
The full bench of the constitution led by Chief Justice Godfrey Chidyausiku heard submissions from both parties’ counsel and reserved judgment to a later date.
South African-based Advocate Tererai Mafukidze instructed by Messrs Joshua Shekede and Givemore Madzoka from Wintertons Legal Practitioners argued the matter for the four parents while Adv Adrian de Bourbon represented Arundel and the school head.
Adv Mafukidze argued that it was unconstitutional for the school to discriminate against the four pupils on the grounds of their religious beliefs and this was a violation of the children’s rights. He said it was unlawful for the four pupils to be forced to worship in a chapel full of religious symbols, unlike in the kingdom halls.
“The kingdom halls differ from other religious buildings and chapels in that they do not contain any religious symbols. Arundel chapel has religious symbols strewn all over,” argued Adv Mafukidze.
He submitted that the school authorities were obliged to respect the four’s religion in line with the constitution. The four pupils, he argued, should be excused from attending the chapel meetings.
“When the applicant’s daughters were admitted at the school they were made to sign a standard form,” said Adv Mafukidze.
“They indicated they are members of Jehovah’s Witnesses. Their applications were accepted notwithstanding their membership of the church.”
Adv Mafukidze accused the current school head of changing the previous exemptions granted to those with particular beliefs from attending chapel services on religious grounds.
But Adv de Bourbon urged the court to dismiss constitutional application. The four parents, he argued, waived one of their many religious rights when they allowed their children to be enrolled at the Anglican school. He accused them of fraudulently seeking to change the school’s principles to suit their needs.
Adv de Bourbon said there was no suggestion from the four parents that an attempt was made to persuade their daughters to change their religion or beliefs.

I'm not on the side of Jehovahs witnesses but I would at least like the hearing to be fair and just.
You bet it is. Have you not bothered to read how and why this was set up? Quit being so self centered to think that the Jehovah's Witnesses are being especially singled out for that so called persecution that they scream about. They are only one of many instuitutions under fire by the Royal Commission.
Educate yourself. The webpage is there with the information as to the "legality" of the Royal Commission and the powers granted it. The Commission has been set up under the order of the Queen of England. They have a well established legal system.
Intellectuals bullies? Lol! Well...if the shoe fits. Tell me why, please, that the experienced, intelligent and rational positioning of legal experts find it so easy to tear apart a bunch of guys who go by "First Century Christian law" instead of the democratic law that recognizes human abuses for what they are.
A fair fight? Not even close. The WTS is getting the shit kicked out of them and it is about time! They are being exposed for the incompetent and arrogant jerks that they are. I am going to cheer for every knock out punch they get. They have been beating up on children and women for far too long now.

The have been moving money out of countries in anticipation for this. Canada's money has always flowed freely downriver to the Tower. And now they have siphoned off the Australian money to the obereas/NY. Where, of course, they have a big building project to pay for.
All those translation offices? Scoop the money out of the palces where they have legal issues. Decrease their funds.
Another thing. The statement shows a $100 liability for each director. That is it. A $100 liability?? Is this a joke?
Personal story: I organized a public awareness campaign one summer (2006). I was doing street performances with groups of women to raise awareness about the Missing and Murdered Women in Canada. Three of my performances were held on city streets - I blocked the streets off for a space to perform. In one of the cities that we performed, I was required by city bylaws to carry 3 and a half million dollars in personal liability to be able to proceed. I didn't have a lot of money but i bought the insurnce policy I needed. $365.
And these guys only carry 100 f**ing dollars liability??? They are "shepherds" and they can't be bothered to insure themselves for some wrongdoing, even if it is accidental? I had no intention of anything bad happening when I took women out on the street to perform in a public palce. I carried the insurance. Because I cared about the people who would be involved, and I cared about those who were watching. I didn't want anybody to be hurt just because of me.

The best part of that 9 second pause is his little gasp for air - Bowditch looks like a goldfish wearing glasses. His mouth opens and closes and nothing comes out. He just sucks in a bit of air. I think Mr. Stewart took pity on him at that point and bailed him out - he might have been worried that Bowditch was about to have a stroke or pass out if he didn't give him a chance to breathe.

In that report, the WT Australia Branch is claiming that they had a loss last year of $1,703,164.
They also report that they spent $10,236,291 in "donations and overseas aid".

I just got to say this. Someone mentioned a while back about the movie potential of this event. I don't think a movie is necessary. For one, I can't think of how anyone could play the part of Bowditch better than he does already. The guy is a comedy act all on his own.
In fact, all of the WT little men are fine actors. Even the blonde bimbo is acting. It is all they can do - they are empty inside - they have no truth to tell. They have to act.
And the heroes of this fine exhibition of intellect and reason could never and should never be replaced. Mr. Stewart and Justice McClelland are superb human beings who deserve the limelight. An actor could never top their honesty, sincerity and presence.
This is kangaroo court up against a real court. Fantasy...meet reality. Boom!

The part where Judge McClelland sticks it to Bowditch about what he had said to his wife to tell BCG. McClelland ends up making him say that his wife lied to him! Lol! it is so great - I have watched it three times already. McClelland is smiling and makes a complete fool out of Bowditch - "we are here to find out the truth, aren't we?" Lol! of course we are...the truth about the truth. heehee.
Okay...I apologize. but...pretty please...one more. The end of the longer clip where Justice McClelland hands the Watchtower lawyer his ass on a plate and makes him eat it. The WT lawyer literally is groveling. It is when the WT guy tries to enter photograph's of BCG's wedding into "evidence". What an idiot - McClelland is superb in that interchange!
