Legal US Social Security for the Disabled (SSD) Question

    First of all, the good news, I am in love and am living with my girlfriend. She is disabled and on a wheelchair (looks isn't everything, it's the soul that counts). She was born with one leg and lost the other to cancer at the age of 15.

    Last night my girlfriend checked her bank account and discovered she received only 250 US dollars (round figure) which was only enough to pay the mortgage on the house (built by Habitat for Humanity).

    Some time ago, SS office stated she was overpaid and owed 50 grand. She had to pay it all back. She appealed twice and lost. The attorney was provided by the SS office (should have been an independant attorney).

    She is very upset. I need legal advice from someone.

    I'd be interested in this thread as I am going to apply for SSD or SSI and they turn everyone down on first application so I'm probably going to have to get a lawyer, cause I'm in the same boat. I need some of the $25K I've paid in taxes over the last 17 years to help me pay my mortgage until I can work again.

    Yiz, you need your own SSD attorney. You may be able to get one Pro-Bono. Find one in your area that has extensive experience with taking SSD cases all the way to the Supreme Court. They are rare, but they are around. Also if the atty handles ADA and Human Rights, he'll have more background in what you need.

    Hey Cyggie. I've been involved in getting my SSD for 2-1/2 years now. Went to my hearing on Aug 9. I will be surprised if I am granted SSD from the hearing.... it did not go nearly as well as we had hoped. And my doc appeared on my behalf (at a $1000 charge because he had to cancel all appts for the day since he was scheduled to be in a town 2 hours away)

    You have a far better "case" than I do... I only have FibroMyalgia - chronic pain, exhaustion, mental cognitive disorder, and all the fun stuff associated with a "syndrome".

    The biggest thing to keep in mind and heart when you start the process, is be prepared to keep at them! Get a good atty. As I said above one who is experienced in taking the case all the way to the Supreme Court if needed.

    They can only charge you a maximum of 25% of the back payment, or $5300, whichever is less. If it goes to final appeals and/or lawsuit, then the atty gets a full 25% of backpayment.

    Plus my GF does not have a long distance carrier, so we can't call out over the phone, however, I can call thru the 'net using the AT&T deaf relay.

    Anybody from Indy by chance?

    We really need help to knock this problem down if it can be possible, my GF really needs the money to live on, especially if anything happens to me and I'm not around to help and support her.

    I suggest a $20 costco calling card for something like 700 minutes. It's what we use at home! Much less expensive than any calling plan our provider has.

    Also, try the Ohio Board of Attys (or whatever it's called... ) for her status and any complaints filed against her, along with checking the BBB.
