    Have you seen the documentary The Fog Of War, McNamara commenting on his role in the incendiary bombs that burned hundred's of thousands of people in Japan. He observed that if the US had not won the war he and General LeMay would be up for War Crimes. War is a terrible thing and we have been at war for over ten years.

    Whoever wins, I am getting ready for the fallout from the philo-Semitism originating from the White House. I remember the last major time where this country did a major act of philo-Semitism. It resulted in an energy crisis, as Saudi Arabia cut off our oil. If we go to war siding with Israel again, Saudi Arabia is likely to cut off our oil shipments and/or drastically raise the price of it again just like in 1973-74.

    Energy crisis, here we come!

    Suffice it to say that this issue was hashed out during the Viet Nam War, yet another undeclared war. A war based on a falsehood of an attack off the coast of Viet Nam, an excuse to commit forces. Congress passed a resolution, but never declared war. Antiwar activists looked to the U.S. Const'n and under the primary sponsorship of Sen. Jacob Javitz, R-NY, passed the War Power Acts. The Supreme Court ruled on the issue.

    This is settled law. When the Const'n was ratified, news took a long time to travel, sometimes many months. Today events are known almost simultaneously. The President needs to respond to breaking emergencies. Congress is cumbersome in the short term. Frankly, I don't believe the War Powers Act would be enacted if the events occurred today. The Supreme Court is very deferential to uses of military power by the executive. Perhaps the most famous case is Korematsu v. United States, which upheld the imprisonment of Japanese-Americans before and during WWII, even though the FBI and the intelligence agency provided evidence that while Japanese espionage was active, Japanese-Americans were not the actors.

    It is a confusing field but there are landmarks. In practical terms, with the election so close, the House leadership will not want to waste time on an impeachment. There are many members of Congress. Each one can introduce whatever bill the Congressperson wishes. The legality of it is does not matter. Any one can find enough fringe members of academia to back up claims. Lawyers hire experts every day. Does anyone ever wonder why the expert testifying at trial always supports the lawyers' position?

    Rather than being flanked by fringe groups, a bipartisan selection of other congresspersons would have signaled this was more than a total joke, enough to make the idiots back home happy.
