Jesus did, though, mention one legitimate basis for divorce: fornication. (Matthew 5:31, 32; 19:8, 9) The word here translated fornication includes all sorts of illicit sexual intercourse outside Scriptural marriage, be it with someone of the same sex or the opposite sex or with an animal.

I can actually imagine something like this being proposed when they were writing the Pay Attention book for elders.

Scriptural Grounds For Divorce

Congregation elders may sanction a divorce only under the following circumstances:

When a member of the congregation seeks divorce from his or her spouse, it must be established by two or more witnesses or by the confession of that spouse to the congregation elders that he or she engaged in actual sexual intercourse with an adult of the opposite sex other than the person he or she is married to in which the penis is fully inserted into the vagina and moved in an in-and-out motion repeatedly until male ejaculation.

When meeting with the married couple, elders should ask for the specific details of the act in question.  Was the person with whom the alleged adultery committed an adult?  Was he or she of the opposite sex as the accused?  Was he or she a human?  Also the elders may wish to inquire further as to the details of the actual act or acts.

Should it be revealed that the sexual act was not intercourse, for instance only oral or anal sex or fondling, then the elders would advise the person seeking the divorce of Jesus' guidance found at Matthew 19:9.  Also the same would be true if the sexual act was commited with one who is not an adult or with an animal.
